ACCEPTABLE USE POLICIES (AUP)

As of July 1, 1997

Discount Internet Services Corporation (DISC) operates a high speed connection to the Internet and offers its available Network and computer facilities to DISC subscribers for personal, commercial and research purposes. During normal usage of DISC resources, subscribers may utilize portions of the Internet that restrict commercial or other traffic as per its own AUP (Acceptable Use Policies). All DISC customers must agree to abide by all AUPs for any networks that they traverse, and always comply with local, state and federal laws.

Account Usage:

1) An individual personal account entitles only the named user to login, and on only one dialup modem, TCP/IP or pseudo-terminal session at a time. Sharing your account with some one is strictly prohibited.

2) Family or Business accounts allow multiple individual with organization to access DISC, but only one at a time, and only one login session.

3) To minimize the busy signals to our customers, all the dial-up ports are set up to be disconnected after the DISC specified ideal time. At the time this agreement was written the ideal (inactivity) time was set to 20 minutes. DISC reserves the right to change this without any prior notification.

4) DISC offers unlimited interactive usage, means that as long as you are setting in front of the computer, you can keep accessing the net. Artificial means of keeping sockets connected beyond the time-out period are not permitted.

5) A quota of megabytes is allocated to individuals accessing a singular account. Disk usage in excess of the allocated quota amount will be billed at $.80 per megabyte per month.

6) Unsolicited commercial mail is forbidden.

Billing and cancellation:

1) DISC subscriber agrees to pay monthly service charge until their account is canceled by signed notification by account holder.

2) DISC customers can pay either by check or credit card, we prefer to take credit card. If the customers selects to pay by credit card then every month DISC will charge the monthly fee on the customer's credit card.

3) If the customer decides to pay by check then it will be customers responsibility to send the payment by the 10th day of the month. We will only send customers e-mail reminder, it will be customers responsibility to check their e-mail and send the payment in time.

4) Accounts unpaid after the 10th of the month may have their service interrupted. Such interruption does not relieve you from the obligation to pay the monthly charge. Only a written request, signed by the account holder to terminate your service relieves you of the obligation to pay.

5) If your check is returned to DISC unpaid then you will be subject to returned check charge of $20.00.

6) If you pay for one (1) year in advance and wish to cancel the account then you will be charged at full rate for the time used, plus two (2) months of service charge as an early exit fee.

Terms and Condition:

1) DISC exercises no control whatsoever over the content of the information passing through DISC network. DISC makes no warranties of any kind, whether expressed or implied, as to the availability, accuracy, or content of the information, products, or services it is providing. DISC also disclaims any warranty of merchandise-ability or fitness for a particular purpose. DISC will not be responsible for any damage you suffer. This includes loss of data resulting from delays, non-deliveries, missed deliveries, or service interruptions caused by its own negligence or your errors or omissions. Use of any information obtained via DISC is at your own risk. DISC specifically denies any responsibility for the accuracy or quality of information obtained through its services and DISC's systems are expected to change from time to time. DISC reserves the right to change any service offered or the features of any service offered or its systems without notice, including changes to access and use procedures, such as idle disconnection's, and systems hardware and software.

2) The Electronic Communications Privacy Act (ECPA) requires we notify you about the privacy of email. You are so notified. You should assume that any email or other communications may be seen by others due to possible software problems on the senders, or receivers end.

3) Any liability of DISC, including without limitation any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, of or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action shall be strictly limited to the amount paid by or on behalf of the customer to DISC for the current month.

4) DISC's network and services may only be used for lawful purposes and consistent with all rights of other parties. Transmission of any material in violation with any US, state or international regulation is prohibited. This includes, but is not limited to: copyrighted material, trademarks, materials protected by trade secret, right of publicity, privacy right or any other right of any person or entity or for the purpose of transmitting or storing of material which is obscene, libelous or defamatory. Customer agrees to indemnify and hold harmless DISC from any claims resulting from use of the service which damages the customer or any other party.

5) DISC reserves the right to terminate or refuse service to anyone, at any time for any reason.

6) When accessing other Networks connected to DISC's systems or networks, customer must comply with those Networks' AUPs.

7) Resale of DISC’s services is strictly forbidden.

8) As a courtesy to subscribers, DISC has accumulated a library of software which is "shareware". DISC is not the author of or otherwise responsible for any of such software or engaged in the sale or licensing of such software. DISC makes no warrants of any kind either expressed or implied. With respect to freeware or shareware available to subscribers. DISC accepts no liability of any kind with respect to such software or any damages resulting from use thereof. Subscriber and any other assumes all risk of all kind with respect to such software. Subscriber and not DISC must pay all shareware license fees. No subscriber or user will assert any claim against DISC with respect to any shareware or freeware obtained through DISC.

9) Use of DISC’s service and systems and the Internet in general is at user's sole risk. DISC does not warrant that its services and systems will be uninterrupted or error free nor does DISC make any warranty as to the results or information obtained from use of its service or systems or the Internet in general.

10) These terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted.

11) By accessing DISC computers user implicitly agrees to be bound by stated terms and conditions within this AUP.
